It depends. In a system of law, some acts should be impermissible regardless of justification or circumstance. Of course, that doesn't mean the same punishment should be given for every instance of a particular crime. But simply because a legal system bears the extenuations of a crime in mind when it apportions the appropriate punishment doesn't mean that the act in question stops being a crime.
